Note about Brixton

For 2021, I carried out an artistic watch with a view to launching a series of editions with 5 young and emerging street art artists ; I had set myself 2 rules: Leave the choice of subject to the artists and carry out the printing at their usual local publisher to optimize the color rendering:

This year 2021, Nerone lives in London; he tells me about his musical influences like Drill (cf:Orelsan), the London nightlife, the neighborhoods he loves. And Brixton comes out, this neighborhood with lively nights, where the clubs display the Neon lights that create this very particular universe that he loves. It is this nocturnal effervescence that Nerone shares in his work... Brixton came out of the Bicep workshops in Bristol, the result is as beautiful as Bicep is effective!

Deliveries of your editions

Process from order taking to delivery of your package , once your orders have been placed .

Once the order is confirmed , we prepare the shipment of your package for home delivery :

Depending on availability, the recipient chooses when to be delivered. All orders will be delivered either to the home, post office or collection point according to each preference.

Rules for sending your order

The packaging of the work is carried out by the artist or by Nightime Gallery depending on its origin, which is either from the artist's studio or from the gallery, in order to guarantee optimal protection of the work for transport.

For each work ordered, we select the carrier best suited to the type of work, with the constant concern of optimizing the protection of the work throughout the duration of transport.

Each shipment is subject to order tracking and has an order number. The package is insured up to the market value.

Transport costs are passed on to the buyer for all individual transport and as a flat rate for editions.

Our packages are delivered to you in person, against signature, most of the time.

If you are not there when the delivery is made, a delivery notice will allow you to collect the package from the Post Office or the partner relay point closest to you, depending on the carrier.

Despite all the precautions taken by the artists and our team to ensure the protection of the works throughout delivery, it is possible that the package arrives damaged.

When you receive the package, take the time to check its condition in the presence of the delivery person.

If you notice that the packaging is damaged, we invite you to indicate this on the delivery note or even to refuse the package depending on its condition.

Take photos, they will help us support the claim with the carrier.

You have 48 hours to let us know!

You have 14 days from receipt of your order to return the work to us, without having to provide reasons or pay penalties. The price of the work purchased will be refunded in full once the gallery has notified us of the correct receipt of the work.

If you are absent at the time of delivery, a notice of passage will enable you to recover the parcel at the Post office or in the relay partner nearest to you, according to the conveyor.

Despite all the precautions taken by the artists and our team to ensure the protection of the works throughout the delivery, it is possible that the package arrives damaged.

Upon receipt of the package, take the time to check its condition in the presence of the delivery person.

If you notice that the packaging is damaged, we invite you to indicate it on the delivery note or even to refuse the package depending on its condition. Take pictures, they will help us to support the claim with the carrier.

Refunds and Returns

ARTICLE: GUARANTEE - RETURNS - REFUNDS - WITHDRAWAL

The items provided by http://nightimegallery.com/ are new and guaranteed against any defect. They are identical to those of traditional commerce and come from all the publishers and suppliers referenced.

If an item is defective or non-compliant, the buyer has 14 business days from receipt of the items to request an exchange or refund. If the fifteen (15) day period normally expires on a Saturday, Sunday or public holiday, it is extended until the next business day.

The customer must return new or unused items in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use and documentation (in their original cellophane packaging imperatively and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to contact@nightimegallery.com (description and photos attached).

In case of exercising the right of withdrawal, Nightime Gallery is required to reimburse the sums paid by the customer, free of charge, if you have notified us with supporting photo within 48 hours of receipt. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s).

Return shipping costs are free in Metropolitan France, respecting the 7-day period if the product has suffered an incident during delivery. You must notify us within 48 hours of receipt.

In case of refund, we guarantee that it will be made within 14 days or less following the date of receipt of the returned package. No cash on delivery shipments will be accepted, whatever the reason.

Tax exemption

For individuals:

The tax reduction is limited to 20% of your taxable income, (and the sale of works is taxed on the capital gain above €5,000). As an individual, if you are subject to the Real Estate Wealth Tax (IFI).

The conditions: obtain an invoice from the seller and the work must have been created by the artist, during his lifetime!

For the company:

A company that invests in an original work of art before December 31, 2025, can deduct the purchase price from its taxable income over five years. To benefit from this tax advantage, the following conditions must be met:

Tax relief for the purchase of a work of art is open to companies:

  • Companies subject to corporate tax

  • Companies and individual entrepreneurs subject to income tax in the BIC category. The tax deduction applies to the purchase of original works entirely executed by the artist during his lifetime.

The works concerned are:

  • Painting, engraving, print and lithograph, printed in limited numbers directly from plates. The art of statuary or sculpture and assemblage. Casting of sculpture in limited edition of 8 copies and controlled by the artist or his beneficiaries. Handmade tapestry, based on original cardboards provided by the artist, limited to 8 copies. Unique ceramic copy, signed by the artist Enamel on copper, 8 numbered copies and signature of the artist. Photograph taken by the artist, signed and numbered within the limit of 30 copies.

On the other hand, manufactured objects, even works of art, do not constitute original works.

The conditions for benefiting from the tax deduction:

Artist still alive

The artist must be alive at the time of purchase of the work . It is up to the company to prove the existence of the artist at the date of acquisition. (e.g. a photo with the artist or a note from the artist)

Exhibition of the work

The company must have the work of art exhibited in a place accessible free of charge to the public or to employees (with the exception of its offices).

The duration of the exhibition is set at 5 years, continuously . This period corresponds to the accounting year during which the work was acquired and the following 4 years.

Concretely, the exhibition of the work can be carried out in different ways:

  • In the company premises , accessible to the public or to employees.

  • In a museum.

  • In a local authority.

  • In a public establishment of a scientific, cultural or professional nature.

  • During events organized by the company or by a museum, a local authority or a public establishment to which the property has been entrusted

Accounting obligations for the acquiring company:

The company must comply with 2 accounting obligations :

  • Record the work as a fixed asset: A durable asset that belongs to a company and has a physical consistency. This could be, for example, land, a building, industrial equipment. in its accounting

  • Allocate the amount of tax deductions to a special reserve account, appearing in the liabilities: Debts (deducted from the company's resources) or fixed financial resources (capital) of the balance sheet. The company must attach to its income statement a document concerning the constitution of this reserve, in accordance with the model presented by the tax administration.

How the deduction is applied:

The basis of the deduction corresponds to the purchase price excluding tax of the work, to which may be added, if any, any incidental costs (e.g. transport of the work). On the other hand, costs that are not included in the purchase price (e.g. commission paid to an art dealer) are excluded from the basis of the deduction. The latter are immediately deductible.

Terms of application

The tax deduction is spread over 5 years (year of acquisition and the following 4 years) in equal fractions. Thus, it is equal each year to 1/5 (20%) of the cost price of the work. If the acquisition is made during the year, the deduction is not reduced prorata temporis: Latin expression meaning in proportion to the time actually elapsed. Allows a calculation to be made taking into account real time.
